Clear, straightforward terms regarding your data, shipping and purchases
1. Introduction
Welcome to philsartsandcrafts.co.uk. These Terms and Conditions govern your use of my website and the purchase of any physical goods or digital media services from me. By placing an order or paying an invoice, you agree to be bound by these terms.
2. Contract Creation & Made-to-Order Work
Because every item and service I offer is bespoke, custom-made, or individually processed to order, a binding contract is formed immediately upon receipt of your payment (or agreed deposit payment).
Handcrafted Woodwork & Art: Work begins once full payment or deposit is cleared. Because raw materials are selected and allocated directly for your order, production starts as soon as payment is confirmed.
Media Archiving & Audio Production: For media digitisation, audio editing, or custom media projects, a binding contract begins once payment is received and initial media files/physical assets are provided.
3. Pricing and Payment
All prices are displayed in GBP (£) and are clear of hidden fees. I reserve the right to adjust prices at any time prior to accepting an order. Full payment (or an agreed deposit) must be cleared through the website checkout or private invoice before work begins or physical items are dispatched.
4. Limitation of Liability
While I strive for perfection across all audio production, media transfer, and woodworking projects, my total liability to you for any losses arising under or in connection with my services is limited strictly to the total purchase price of your order. I am not liable for any pre-existing damage to legacy media assets (such as fragile VHS tapes, Digital 8, or audio cassettes) supplied to me for archiving.
5. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

1. Who I Am
Phil’s Arts and Crafts (“I”, “my”, “me”) operates the website philsartsandcrafts.co.uk. For the purposes of the UK General Data Protection Regulation (UK GDPR), I am the data controller responsible for your personal information.
2. Data I Collect
I only collect the essential personal data required to fulfill your requests, including:
* Contact details (Name, shipping address, email address, phone number).
* Source materials supplied by you (digital files for audio editing, physically or digitally submitted photos for portrait drawings, legacy physical media for digital conversion).
3. How I Use Your Data
I use your information strictly to:
* Process and ship your handcrafted wooden orders.
* Communicate with you regarding design briefs, audio edits, or custom project updates.
* Comply with statutory UK accounting and tax obligations.
4. Data Retention & Media Security
*Customer Details: Kept in line with UK tax law requirements (typically 6 years).
*Project Media Assets: Your personal media, custom portrait scans, and raw audio files are stored securely on local, encrypted drives during the editing process. Once a media archiving or video project is completed, delivered, and approved by you, I securely delete or return the source media, unless you have chosen the private Google Drive link and/or private unlisted YouTube upload option for personal download and sharing, in which case these remain active for a period of one month before deletion. Your physical USB drive, where ordered, remains your only permanent copy.

1. Bespoke & Made-to-Order Goods
Every piece I create at Phil’s Arts & Crafts—from handcrafted garden woodwork and custom-painted pieces to bespoke media production—is individually made or edited to order. I do not carry pre-made or off-the-shelf stock.
Exemption from the 14-Day Right to Cancel: Under UK Consumer Contracts Regulations, the standard 14-day “right to cancel” or return an item does not apply to custom-made, personalized, or bespoke goods, nor does it apply to completed digital services once delivered.
Order Changes or Cancellations: Because work begins shortly after an order is placed, please contact me as soon as possible if you need to alter or cancel an order. Once timber has been cut, paintwork started, or media processing begun, orders cannot be cancelled.
2. Damaged or Faulty Items
I take immense pride in the quality of my work and ensure everything is carefully packaged before leaving the workshop. However, if your order arrives damaged or with a defect:
Please contact me within 30 days of delivery via my Contact Page.
Include a brief description and clear photographic evidence of the damage.
I will gladly work with you to arrange a repair, a replacement, or a full refund at no additional cost to you.
3. Digital Media Services
For digital media projects (including audio editing, video projects, and media archiving), I ensure you have the opportunity to review and approve drafts where applicable. Once final digital files have been rendered and delivered, refunds cannot be issued.

1. Eligible Shipping Items & Destinations
To ensure safe transit and manageable courier costs, I only offer standard UK / worldwide postal shipping for my novelty garden animals and handcrafted bird boxes. Pencil portraits are UK delivery only via Crafter’s Market, however shipping for these items is worldwide via my contact form. Media archiving orders (tapes for digitisation) can be sent to my studio via UK or international tracked post from anywhere outside my free 5-mile collection radius.
2. Bulky Items Collection Only
I do not ship larger, heavy, or structurally complex items through standard courier networks. This includes:
* Planters
* Bird tables
* Any other heavy-duty garden structures
These items are strictly available for local pickup/collection from my workshop premises in the Bolton area, or via independent, pre-arranged local delivery where possible.
3. Media Archiving: Postal Send-In & Return If you’re outside my free 5-mile collection area, or based outside the UK, you’re welcome to post your tapes to my studio for digitisation. Please package tapes securely to prevent damage in transit — guidance is provided upon booking. Return postage for your digitised media (USB drive and/or original tapes) is calculated based on the weight of your parcel, and will be confirmed at time of order. For international or unusually large orders, I may ask you to weigh your box of tapes before sending, so I can provide an accurate return shipping estimate upfront. I am not responsible for tapes lost or damaged in transit to my studio. I recommend using a tracked postal service for your own peace of mind.
4. Processing & Delivery Times
Because my novelty animals and bird boxes are meticulously handcrafted from quality treated pine, timber, and select materials, processing times can vary:
*Made-to-Order Items: Processing time will be clearly communicated upon ordering (typically 1–2 weeks).
*All shippable items are sent via reputable UK couriers (such as Royal Mail) with tracking enabled.
*International customers are responsible for any customs fees or import duties on their returned parcel
