Legal & Customer Policies
Clear, straightforward terms regarding your data, shipping and purchases
1. Introduction
Welcome to philsartsandcrafts.co.uk. These Terms and Conditions govern your use of our website and the purchase of any physical goods or digital media services from us. By placing an order, you agree to be bound by these terms.
2. Contract Creation & Personalised Work
Physical Goods: For standard items (such as novelty garden animals and bird boxes), a binding contract is formed once payment is processed and your dispatch email is sent.
Digital & Custom Commissions: For bespoke creative projects (including pencil portraits, custom timber furniture, audio production, and media archiving), a contract is formed upon written agreement of a brief and a specified deposit payment.
3. Pricing and Payment
All prices are displayed in GBP (£) and are clear of hidden fees. We reserve the right to adjust prices at any time before accepting an order. Payment must be made in full through our checkout gateway before standard items are shipped.
4. Limitation of Liability
While we strive for perfection across all audio production, media transfer, and woodworking projects, our total liability to you for any losses arising under or in connection with our services will be limited strictly to the total purchase price of your order. We are not liable for any pre-existing damage to legacy media tapes (VHS, Digital 8, cassettes) provided to us for archiving.
5. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Data We Collect
We only collect the essential personal data required to fulfill your requests, including:
* Contact details (Name, shipping address, email address, phone number).

3. How We Use Your Data
We use your information strictly to:
* Process and ship your handcrafted wooden orders.
* Communicate with you regarding design briefs, audio edits, or custom project updates.

4. Data Retention & Media Security
*Customer Details: Kept in line with UK tax law requirements (typically 6 years).
*Project Media Assets: Your personal family photos, custom portrait scans, and raw audio files are stored securely on local, encrypted drives during the editing process. Once a media archiving or video project is completed, delivered, and approved by you, we securely delete or return the source media, retaining no copies unless explicitly requested for future backup.
* We never sell, lease, or distribute your personal data to third parties
1. Standard Stock Items (Novelty Animals & Bird Boxes)
In accordance with the UK Consumer Rights Act 2015, you have the right to change your mind and cancel your order for standard online items (such as pre-made novelty garden animals and bird boxes) within *14 days* of receiving your goods.
* To initiate a return, you must notify us via our Contact Page.
* Items must be returned to us unused, undamaged, and in their original packaging.
* Return Shipping: The buyer is responsible for return postage costs unless the item arrived damaged or faulty.
2. Exemptions from the 14-Day Return Window (Custom & Digital Work)
Please note that under UK law, the right to cancel does not apply to:
*Bespoke or Custom-Made Goods: This includes hand-drawn pencil portraits, custom-built bulky wooden goods, or any woodwork items modified to your specific dimensions.
*Completed Digital Services: This includes fully rendered audio advertisements, video editing projects, or digital media archiving once the work has been completed and delivered to you.
